Legalization Could Put Me in a Bind

I work at a company that does not do random drug testing. I got tested when I was hired, but not in the 18 years since.

However, I heard our vice president yesterday say that if marijuana is ever legalized in our state, he will see to it that random drug testing is instated at our company, and that everyone will get randomly tested at least once per year, and maybe every 6 months. Under a "one strike and you're out" policy.

I'm not sure he could legally do that, but maybe he could. I don't know. We're salaried employees, not under a union.

I've read that some states where marijuana is legal still allow employers to fire any employee who uses marijuana, even if they have a legal prescription for it.

The cost to pee test is expensive for a company, which is why they normally only do it for new hires and for people holding positions that, if they're under the influence, they can cause a safety hazard. He'll change his tune real quick, and the company probably won't back him in the idea (as he's only a VP and drug policy needs to be established by CEO or board), when they see what the cost would be. Not too mention, he won't have an employee left to do the work, lol.

yes..you can still get fired for a Positive test....Im in Washington where we have recreation use....There will be a Day when I see someone make Law suit against employer for being fired for Piss test....You can be at the club and take a few hits on Friday with friends and then be tested a week later...even though you did smoke on your time...More people cause issues from comeing into work Hung over ...So I say look for Law suites to come....

I had a boss who did not drug test because he said he needed employees. It is hard to find people in the trades that don't smoke. One of the guys I worked with that eventually owned his own plumbing company and joked about drug testing.....but for the reverse reasons. He didn't want to hire anyone who didn't smoke.

its not a free country we live in by any means. This is a perfect example of too much oversight into my private life IMO.
If I showed up at work drunk I would expect that not to be ok, same goes for being stoned. But getting drunk after work is ok? So getting stoned after work should be too. But alas I digress. I live in a state where I lie that I am sick, So I can have a pass to do what is my own personal right anyways... Kinda messed up for the people that are really sick.
